I have agreed to participate in Urban Gorillas SL. exercise classes.

The activities of outdoor training, strength training, running, agility drills, jumping, intense cardiovascular activities and flexibility training are all part of the sessions.

I acknowledge that there are risks associated with physical activity. These include but are not limited to, those caused by terrain, facilities, temperature, weather, my physical condition, equipment, actions of other people included by not limited to, participants, volunteers and lack of hydration.

In consideration of my being accepted as a client, I agree to release and discharge Urban Gorillas SL. and any of its employees, volunteers and supervisors, from any injuries sustained by me as a result of participation in this program.

I agree to indemnify and hold harmless Urban Gorillas SL. and any of its employees, volunteers and supervisors, Urban Gorillas SL. against any liability incurred as a result of such injury or loss that may occur as a result of my participation other than as a result of Urban Gorillas negligence.

Fitness activities and programs require that I be in good health and have no condition that could endanger my well-being through participation. I will notify Urban Gorillas of any such defects in writing prior to attending any training session.

I agree to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of myself.

Bootcamps can be intense, especially if you push yourself. Be sure to take it easy off the start and work your way up to more intense exercise. This is especially important if you used to be sedentary.

I commit to work at a pace that is safe for me and within my current limits and notifying my trainer if I feel unwell.

By attending this class, I give Urban Gorillas SL. and any partners permission to post and tag (with my full name) photos and videos containing my image on their website, Facebook, Instagram, Twitter, YouTube, other social media and in print and video for promotional and marketing purposes.

DO NOT AGREE TO THIS AGREEMENT AND CLASSES UNLESS YOU UNDERSTAND THE TERMS COMPLETELY. IF YOU DO NOT UNDERSTAND, YOU SHOULD SEEK LEGAL COUNSEL.

Cancellation of Class bookings Classes booked must be cancelled no less than 12 day hours before the class’s advertised start time (08.00-20.00hrs).  

Cancellation of your membership You may cancel your membership at any time after the payment of the first 4 months of fees, please note that you must cancel minimum 1 month before your next payment, to ensure that no further payments will be taken.

If you pay by debit or credit card and wish to cancel, then please email hello@urbangorillas.fitness with your full name & date of birth. 

Cancellation by us: We may cancel your membership without notice if you commit a material breach of this agreement including, but not limited to, a breach of the membership rules, abuse or threatening behaviour or vandalism or other illegal activity.

We may cancel your membership with immediate effect if: 1 you have breached any terms and conditions of this agreement; or 2 membership fees or other charges remain unpaid 7 days after the due date and such a breach is not remedied by you within seven days, after being notified by us.

We may cancel your membership without notice if you continually fail to cancel classes.

We may cancel your membership with immediate effect if Urban Gorillas permanently ceases operation, In these circumstances, we will consider providing a pro rata refund for membership fees already paid in respect of any period after the cancellation date. FORCE MAJEURE

For the purposes of this agreement, a Force Majeure Event means an event beyond the reasonable control of Urban Gorillas including but not limited to strikes, lock-outs or other industrial disputes (whether involving Urban Gorillas or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

Urban Gorillas shall not be liable to you as a result of any delay or failure to perform its obligations under this agreement as a result of a Force Majeure Event. If the Force Majeure Event prevents Urban Gorillas from providing any of the services for more than 90 days, Urban Gorillas may, without limiting its other rights or remedies, have the right to terminate this agreement immediately by giving written notice to you.

GENERAL

Our failure to enforce any of our rights at any time, for any period and for whatever reason will not be construed as a waiver of such rights; neither will any failure to identify or act upon your breach of the terms of this agreement be deemed to be an affirmation by us that your behaviour is acceptable.

Where a provision of this agreement is deemed to be invalid or unenforceable by any Spanish Court, the provision will be deleted but such deletion will not affect the validity and enforceability of the remaining provisions.

We may assign or transfer the benefit of this agreement our obligations under it, to any other legal entity at any time without notice to you.

All and any Intellectual Property Rights in or arising out of or in connection with the services provided or in relation to this agreement shall be owned by Urban Gorillas.

Except where permitted by this agreement, neither party may alter the terms and conditions without the written agreement of the other party and no written or oral representation by either party will serve to modify or amend these terms and conditions in any way.

This agreement shall be governed by Spanish law and the Spanish courts shall have exclusive jurisdiction to deal with any disputes arising in relation to it.
